Call 1-800-304-3107 and see if FMS is showing your refund as being subject to an offset or not.
If the loan was dispersed they should not take your taxes. You may have to send them a copy of your discharge papers.
If the loan is discharged, IRS should not keep your tax refund.
Normally, debt cancelled must be reported as income on the tax return.
